You can say renters must have X credit score, X debt to income, no evictions, etc but the moment you leave it up to judgement you start taking on risk.

In this VERY summarized version I also check the property for repair costs, get contractors to the property, check ARV, do a title search to make sure no one else is on title (ex spouse or parents), make sure there are no liens or judgements on the person or the property, and figure out what is best for the seller.

The security deposit is a mute point ,,, the back rent, the court fees, the damages, it will help offset some of the costs but not all .. photos of unit condition at move out.. send sec dep statement out within the time frame required and if you don't get your money you can go to small claims court where you'll get a judgement but collecting is a hassle.You've almost got possession,, don't give up.. and Don't physically force them out yourself, or do anything else stupid, that's what the sheriff is for. good Luck

New York is a Judicial Foreclosure State which means the mortgage holder must sue the mortgage holder and receive a judgement from the court which I assume is public information.
