@Jason Howell now GENERALLY speaking it has been a sales tool that has been used to give false sense of security to investors.. they will skip over some issues in due diligence etc and rely on this guarantee.. there is one thing to say pay a few months rent in the beginning but a full blown year long gurantee is really risky on the TK companies part..but I will let Chris chime in he is the expert at this..

If you have disclosed you are an investor and that you intend to make a profit and you have not colluded, influenced or coerced anyone to make false claims or actions, then it is not mortgage fraud.

An option does not convey such an interest in some states and you can get into filing false liens, even though it is a federal issue under the Uniform Commercial Code.

We had a discussion about filing false liens here as some thought it would be a good way for asset protection, as a sham transaction, but the B/M would not be a sham if you actually made a loan.
