This is typically true even if you say you will offer the agent a commission, as most agents don't want to deal with negotiating the commission in advance and signing a commission agreement without knowing if their buyer is even interested - that's the good thing about the flat fee MLS listing, as there is a binding commission offer stated in the MLS.N.A.R. statistics will show that FSBO is at record lows and falling, but this is deceptive as it is generally accepted that most FSBOs are instead moving to flat fee MLS listings (which is technically considered For Sale by Agent).

OK, I am good at doing referrals, finding, and birddogging for buyers and sellers and get paid that amount that they pay you for your help, but this bugs me, i had a friend(not a lawyer) tell me that it is legally binding between you and a buyer or seller if you offer you "finder" services and tell them in the email "If you agree and send a message that says Yes then that will our legally binding agreement that you will pay me if I find you a property and you buy or help sell your property and it sells to my buyer".

ACCEPTANCE: This instrument will become a legally binding contract when accepted by the Seller and signed by both Buyer and Seller." - They never even sent me a copy of the contract signed by them!

So I printed the addendum again, changed the closing date again and sent it back to them, but I forgot to add in again "the price shall be $740,000" Naturally they signed it and are telling me that we are mutual and binding now at $650.

We would just go in circles and at the end of the day, its just a big fat waste of time to talk to them.If I were to do it before the year is up, it would probably just be best to do it, then if i do get the call or nasty letter from them, explain myself at that point in time.You do bring up a good point though with the change of address thing, the fact you got that letter at least lets me know me they are keeping thier eye on that.Which is why im still planning on changing my address now while i still live here to a po box.
