You can offer the seller a few thousand dollars more and see if they can get the tenants out, but unless you are a super experienced landlord, my understanding with the law in CA, this can be a very lengthy and painful process for most.

Entitlement on a property is sometimes a very expensive and lengthy process - so if you have plans to take the property and do something with it, make sure you have a good plan in place and place the details in the contract that it's subject to getting the proper Entitlement.

I wouldn't inform the tenant of this until about a month before (or whatever the minimum length is in your lease) that you won't be re-signing him as to not cause any more tension in the relationship which could result in damaged property or him not paying rent.

To be a legal shear/brace wall the minimum length is 2ft-8in for a 8ft wall (that is the wall segments between door and window openings).
