We have to dig a little more but there are deals.

I made a lot of money with real estate deals where other investors just didn't want to bother, because it wasn't cookie-cutter and 'there's always another deal', so they don't want to look at difficult titles or dig a little deeper. 

You have to dig a trench about 2 feet deep where the tree may penetrate to the house, so you can do it youself, probably a lot of work. 

If it's in or near KC we'd be happy to dig a little bit deeper into the analysis to assist you.There's a # of factors off the top of my head to consider besides the things that have already been mentioned:  location, age, square footage, real ARV, taxes, etc.

Next see if you can dig a bunch of folks who are suing him to file a Lis pendens on any possible damages in the suit to make it clear he will never see a dime.
