The way to handle this is to tell your tenant they can move in anytime they want and the lease starts Oct 15, since you already agreed to that change.

Regardless of the K1 being final, any time you have 1231 gains on K1, they are "gains from passive activity" and they can be offset by losses from any other passive activity, i.e. your $125k stash.3.

Otherwise, anytime someone puts a small hole in a wall a landlord could use that as an excuse to oust them.
