While you can get all theoretical about it and argue the time value of money and how your discount rate need to be higher than 6.25% to justify that capital outlay, the bottom line is that this AC unit is 35+ years, is costing you $500 per year, and is highly likely to cause you another issue in the near term.

@Allison W GammonIf it will only last another 2-3 years I would still fight for a credit - not fill replacement but I would argue for something - no different if the roof only had 1-3 years left on it - I would push for a credit on that as well.

I think it could be argued quite easily that because the lender did not include the parking space in the legal description in the mortgage then it did not convey with the condo unit in the foreclosure.
