I’d say no and then come by and remedy the situation myself and everyone is happy.

The reason I say that it is a good start is that you have to understand that different legal entities (trusts, LLC, corporations, etc.) have different legal remedies associated with them in varying situations. 

Many flips don't have a seller's disclosure so there is no remedy other than against the inspector possibly who did the inspection, if they were negligent in missing obvious things.

The HOA is preparing the sue the builder to remedy the problem.
