My units did not have the level of disrepair your does so I think a judge might interpret you possibly grossly neglecting or mismanaging your property from afar and be more sympathetic to the tenant than usual.In my cases the tenants were inherited free loaders and talked about small wear and tear items the judge scoffed at or dime size stains on ceilings etc.No legal advice

Yeah, if you don't trust him to go, then go ahead and spend the $130 so you at least have that eviction already in the works if he doesn't leave.Also be sure you do not give him a dime until he is outside and gives you the keys.
