Since the tenant is arguing there's a different amount for the deposit, they obviously were not involved in competing the estoppel which means it was done improperly and is pointless.You only have $1,000 for the deposit and the deposit should not be applied towards anything until the tenant vacates and the lease is terminated.

The non-refundable pet deposit sounds like a fee, so I would deduct cleaning fees from any regular deposit the tenant paid If the language says "non-refundable deposit" could it be argued legally that this is not the same if the word "fee" is not actually in there?

If you purchase the commercial property at a favorable price, cap rate, and favorable loan terms I would argue that might be a good option, but if those factors aren't there and the BRRR's provide higher ROI's then I would sway towards that option.
