From some additional research, it seems that Texas is a non-disclosure state, which could be the reason why there isn't that much information out there.

Had we dug into the "3-5 years old" disclosure better we would have found that the older folks who sold the home were most likely remembering things wrong because after the sale we got up there and found it to be near the end of its lifetime.

A broker, acting as a broker under the guidelines of regulatory agencies, acting with the knowledge that they have a duty and responsibility bound by their licensing and being paid a traditional brokerage fee with full disclosure on the HUD of the amount is perfectly fine and there is no difference.
