I have a few tenants who constantly have the same problems at my apartment complex, but all 24 units are identical, so it's clearly something the tenant is doing.

Something I may have missed in the discussion is how you build identity via your "voice" or if you prefer, the sound your copy makes in the readers head when read. 

If I have two identical offers except that one buyer is more financially capable, I can choose the offer of the more financially capable party.

I will say however that the rate you are getting for your identical unit is the Market Rate and NOT the Rental Rate.

It never ceases to amaze me how few people have heard of this before on here, but a major study that looked at something like a century (give or take) of RE data in the USA found that the overall rate of return in cash flow vs appreciation markets was basically identical over the long term.

Not as much as the summer months but yes, with the sheer amount of "identical" listings available, I do believe the bulk of these will struggle in the winter and going forward.

He (and other attorneys) like to target them because unlike the auto-warranty spam calls, it's highly likely that you'll be able to identify the real estate investor because they will eventually reveal their identity. 

I have told you before and I'll tell you again, I believe that the main ingredient of your success has been that you and your partner (your brother) share identical or nearly identical principles/values/work ethic.
