While under normal circumstances it would be the tenants responsibility to have renters insurance to cover moldy clothes, since the problem wasn't immediately fixed they could easily counter argue that it was the landlords negligence in fixing a health related item in a timely manner that caused the damage and not just a standard case of a moldy apartment.

I will ask here: If someone is selling me a home for $100k and I ask for a $20k cash back to do whatever I want, from repair or any improvements and it is FULLY DISCLOSE on the closing sheet why some people argue that this is illegal or fraud.

Most people will also hire an Attorney to present/argue the case to the Zoning Board of Appeals as the key thing they are looking for is for you to prove a "Hardship" as to why this should be allowed.I also highly recommend getting an updated Plat of Survey (if you don't have one already) to ensure your calculation of your lot area is accurate and you don't happen to already have 4,000 sq.ft.
