So even if you pick a state with stronger protections like WY or NV, the cause of action arose in the state where the tenant fell, so likely that the court where the accident happened would have jurisdiction.

The reason they sell those insurance plans is because they make a lot of money off of them.If a $1,000 unexpected expense will cause a problem for you, it may make sense to have that insurance.

Things like:- having them name you as an additional insured- having their policy be Primary and Non-contributory- Requiring that their policy provide 30 day notice of cancellation- Having their policy waive subrogationThe Tenant should have General Liability, Professioanal Liability, Workers Compensation, Business Auto, and possibly Accident/medical coverage.
