For the owner:  time to cowboy up and pay your own way - and that means settling this transaction. 

After negotiating back n fourth we settled at $180k.

I assume that since it is new construction, over time the ground settles and could probably be the root cause of this. 

After settling in I'm ready to start investing in Utah properties and add value to the community where I can.  

You may be best trying to settle to split the EMD so it doesn't sit in escrow forever. 

Maybe it looked good when the builder handed off the keys but if the backfill soil isn’t compacted well along the foundation, it’ll settle pretty quickly with all the rain we’ve had this year. 

In long term I may settle for hybrid or something like only taking 50k loans, syndication, accelerated depreciation (assuming bonus depreciation doesnt go away) , pay back and repeat. 

They settle within your policy limits so that you will settle and they can get paid. it's an extreme rarity that some lawyer chases you down for your last penny when they could have been paid quickly through settlement.No LLC will provide any tax advantage.

Once “the dust is settled “ I will continue investing with RTR.
