If the existing lease is well-written and meets your standards, you can keep them under that on a month-to-month basis, at least for a trial.

A tenant can dodge service, can file an answer claiming the service was improper, can claim the residence is uninhabitable requiring an inspection and can challenge the eviction in court and go all the way to a jury trial whether or not there is any basis to their claims.
