@Thomas Rutkowski my attorneys are on retainer, and if they are the ones who wrote legislationfor the IRS I don't see why "paying" them would change the outcome. 2nd, here a quote from IRS handbook....it seems your attorneys like to bet the audit game.If you sell property for which you claimed or could have claimed a depreciation deduction, you must report any depreciation recapture income in the year of sale, whether or not an installment payment was received that year.

I've learned/read on this and retained absolutely zilch, so I won't even try, but if my memory serves me, it's something how it all breaks down annually with math and numbers and things and stuff and the bottom line was APR was the number you really need to worry about (take that as a grain of salt!)

Like most, I see two main areas of loss mit (Home Retention): Forebearance and Modification (where the debtor retains property) and (Short Sale and Deed in Lieu)I personally will always try and negotiate a Forebearance and Mod first...if successful I feel as if I saved the Bank at least 5% of the note amount plus the commission.
