So...barring the delay of probate and/or 1 of 8 siblings entering the conversation, I expect to have the NEW seller be empowered as the executor of the will and announced that he is the NEW owner...therefore allowing him to sell it prior to foreclosure.

First of all, you would need to discount the not much more, and secondly you would need to pay cash to close, then sell the note.The more proper structure would be for you to double close and have your note buyer actually be the creator of the note for your end buyer and thus take the position as your buyer's lender.What interest rate are you expecting to get for your buyer?
