My point in citing those cases was that we shouldn’t automatically assume an LLC member is subject to Sec 469(h)(2).Still, taxpayer is a REP and materially participates in their own rentals.

Thanks Thanks Ahmet and agreed.Life is too short for negativity.It wouldn't be the first time we have bought a property back at the detriment to our company.Hopefully the last...We take full responsibility when it's ours to take and even when it isn't ours.Our preference is to not reveal dirty laundry and if pushed, we will have no choice other than to defend our reputation.It is my belief that all can be re-solved behind closed doors and for everyone to walk away with the least sour taste.Again, my apologies and I wish you both all the best in life and investing.

To be assumable you need a purchase contract with the owner, settlement statement/payoffs to show your down payment makes any sense against what is owed.If the HOA really succeeds, you will see that a Board member is miraculously on the transfer sale deed...The HOA cannot sign a contract to sell to you (they don't own it yet).

If you're planning on building an ADU or JADU 'yourself', my suggestion is to make sure you have some previous knowledge of construction and also make sure you know good sub-contractors in the following trades: electrical, plumbing, foundation, roofing, framing, drywall/paint, stucco, tile, cabinetry, flooring, HVAC, concrete, etc.The last thing you want is poor quality work that has to be re-done because a handyman or the wrong tradesman did the work.
