That is a black and white scenario and usually things are a shade of gray.  

Some advice I could give you, read as much as you can about real estate and talk with investors with gray hair!

I just bought a house in WA state, and with the passing of this law there is gray lattitude a mile wide for tenants to possess and use marijuana in my rental, which down the road could have legal liabilities on me as the landlord.

I decided to get my license for 2 reasons, 1) all of the properties that I have to pass along to my realtor that I can't wholesale, I now can list them and get all the money from the commissions and 2) Florida is one of those states where wholesaling is a real gray area without a real estate license and I want to have a legit scalable business without having any potential legal ramifications, and getting your license in florida is pretty simple as you know.

The curent buildings are all light gray.

We are flipping out first house and using the white trim, White doors gray paint on walls.

I would say it is kind of in a gray area right now, but if you used that smoking clause to force cessation by the tenant and had to eventually evict because of it, you may find sympathy in a court should it come to that; most businesses that I know of ban e-smoking inside just like regular cigarettes.
