It's not fair dealing.A note is a bi-lateral contract, it requires consent of the lender to assign the note or any of the collateral held, much like laying to waste of any collateral.

Bilateral and unilateral contracts, any financing contract is a unilateral contract and it may NOT be assigned without consent of the party owed. 

Establish a bilateral contract that stipulates that you are acquiring equitable interest in the property.I would also consult an investor friendly attorney as they can provide more insight for you.

You could have someone with severe bilateral hand issues who needs a trained monkey to open doors and turn on lights.  

At very least, Isn't a commercial landlord still required to furnish a bilaterally executed 48-hour move-out inspection/checklist?!
