What I was implying is that commissions are not given by or to anyone, they are EARNED by agents for fulfilling the terms of a work contract.

If the seller gives valid consideration in exchange for the buyer's promise to do something, then the seller can sue the buyer for breach of contract if the buyer does not fulfill the promise.
