Whether they agree will depend on how motivated the seller is and how solid of a buyer you appear to be, but I requested this on my very first purchase and got it.To @James Maradits' point above, if the seller represents the contracts as month-to-month and they turn out to be different, I would think this is fraud that would allow you to cancel the contract or seek some other remedy (not legal advice - consult a lawyer!).

The fundamentals are sound and have made a clear difference in outcomes (Prevention is always less costly than Remediation).

It also puts thse owner on notice and fines increase for repeat offenses - up to and including prohibiting the property from being rented as a remedy.

New insurance companies pop up with new types of insurance: say in Florida they never cover your roof or never remediate the flood waters- it's up to you to fix it 3.

And as you said it can be a costly issue to remedy if you happen to be the owner at the time that the violation is discovered.

That said, I am really not a fan of negative cash flows unless you have a clear short term plan to remediate.

Many commercial lenders specifically prohibit 2nd position liens and many lenders won't take a 2nd due to the added risk and diminished remedies.

You follow the remedies spelled out in your lease.
