I know it can be done for real estate brokers because both real estate brokers involved in this transaction forfeited approximately $10K between the both of them to get this deal closed on the front end (it's a rather large loan just under $1MM).Any insight into this would be greatly appreciated.

In theory, you could forfeit your business assets to the plaintiff, say $500k in the property itself, and be done, as that is all the assets in the LLC.

Now if there are stains that go beyond what a standard vacuum can clean, then maybe a forfeit of deposit is necessary so the landlord can incur costs of the cleaning.

Defaulting on the loan is a taxable event, and will be accompanied by a 10% penalty.If your other losses will offset that cost at the bottom line level of your tax return, then I suppose you could look at it that way.I would strongly consider the impact of forfeiting the tax-sheltered retirement savings, however.
