You should bill them both for the damages, take pictures and go to court.

This could lead to a huge tax bill and penalties.Think carefully before you do this.Good luck. 

Everyone on here is saying that you can do it, but it's definitely not possible if you don't have a lease in place on the unit you are currently living in or can show you are living somewhere else with a utility bill or rental lease  to demonstrate that you are not intending to live in the subject property.

I have an appointment with a land attorney late this week and now will be getting a significant legal bill out of all this as it will turn into much more than the cost of a consultation.

If they are billed separately, the charges may fall into Fair Debt Collection Practices Act laws.

If I bring on an agent who does not join, I get billed for it and all my agents memberships gets suspended if the balance is past due.  

One of my attorneys just sent me a bill reminder a couple of weeks ago for a fee I had already paid back in June/July, which never went through, and that I sent again in August.
