Long story short, after talking to the Mgmt company and their attorney the case was pulled at the courthouse and an entry was made in the record to strike my name as a defendant.

We all know someone with a car that lives at the shop, is a legally verifiable lemon, but they defend it to death.

Through a very good lawyer we have started the eviction process and filed counterclaims for legal fees and back rent as well as a cross claim demanding the previous owner defend our interest since we were issued a general warranty deed.

Don't think that a savy ACLU or ADA lawyer wouldn't leverage HIPPA to defend a person's right to not be forced to disclose protected healthcare information to satisfy a landlord's issues with "pets".  

Owners can find themselves having to defend themselves from a very costly lawsuit which could go on for a year or more, all because they left items behind for the tenants to use.

They should have a boiler plate one that like to defend.

For example, the risk of getting sued over $1000-$2000 deposit vs. the cost to defend a suit if you need to hire counsel.

If all these questions are too much for you to handle Travis, than i suggest you don't jump on the podium and declare your market is the best of em all if not ready to defend the statement. 

Always keep in mind that the appraiser needs to be able to defend their opinion with actual data (USPAP regs), otherwise they cannot usually make an adjustment.

Just a question... are the ones who are most fervently defending this market and insisting that it can't crash the same ones that would be hurt the most if it did?
