Transferring assets to a business entity for the sole purpose of lawsuit protection is a violation of the Uniform Fraudulent Transfer Act, and, if you are sued, your presumed "asset protection" will likely evaporate.

Joe, I am not familiar with Virginia's common interest ownership act (CIOA) specifically but if it is similar to the uniform CIOA then I don't think creating a homeowner's association will help.
