most of those transactions you as the buyer pay a premium FAR exceeding a 3% RE fee but people still use them and seek them out thinking they are getting some off market deal when in fact its on market .. its just the wholesalers market not the mLS>

They most certainly should seek legal opinions and consult with government agencies.
