I did consult with a friend who is an attorney he suggested I pay for the hotel, meals + reimburse the tenant for the days they have not stayed home & won't be staying home in the future.

The last $30K or so that I spent was, of course, not reimbursed from the construction escrow account.There is a small amount (approx $9000) remaining the construction account, and it's with a reputable escrow company.

In fact, we often do this for our buyers when they use our broker.You are going to be taking the risk of losing that money if the buyer backs out or can't get the loan, but if the buyer backs out, I get the earnest money (which will reimburse me for the appraisal costs) and if the buyer doesn't get the loan, then my broker screwed up (this hasn't happened yet).

If the HML lends you everything you need for the purchase plus rehab, you will still need 10-15% of ARV to cover your own costs (points on the loan, purchase closing costs, holding costs) and you need cash to pay for the work prior to getting the reimbursement from the HML for the work.
