@Paul KangIf you have not depreciated the property on two or more tax returns you'd file a Form 3115 to change the depreciation method from impermissible to permissible with your current tax return.Might want to shop for a new CPA if your current one is advising you to not depreciate to avoid 1250 gain...

The only positive I can see here is for PM companies as it is extremely difficult to attain/keep Superhost as we have to go to owner's for permission to do sometimes necessary repairs and then one or two lagging listings can bring our averages down.

In essence, it's like transferring the property to someone else (or something else) without their permission, which is required unless you have an assumable loan without qualification.So, going with the assumption that you have the property in an LLC and either do not have a loan on the property, or the loan attached is also in the name of the LLC, then you can set up a structure where you first create a Trust.

I did not grant explicit permission of entry but as stated it did sound like she had provided a key to her family and I was hopeful that everything would be taken out without me needed to get involved much.
