I believe you misunderstood my statement....aside from any alleged "conflict of interest/misrepresentation", what I said was that nothing that happens in a probate  hinders a mortgage holder from foreclosing...it's not the lender's problem, and their foreclosure is not affected by probate issues.  

While what @Cameron Pricesaid seems correct, please check with a tax attorney or CPA regarding using your retirement account.
