This is where I see most of the errors happening.If you use for instance an attorney that only does commercial real estate they will run into these issues and many more on a daily basis Their level of knowledge will tend to be highly sophisticated in this one area of contracts.I have no clue what could have been changed.

Unless they inherited their money and spent their entire lives partying, they are usually quite sophisticated about investments.

@Derek Daun LoL, I was stationed in Las Vegas for 5 years and I always compare insurance to gambling casinos....you give them your money and they never have to give you anything in return.  

My thoughts on RE/MAX was that they were by far the most sophisticated in consideration of who is managing the franchise.

Making loans to investors should be viewed as any other commercial lending activity, they should be sophisticated borrowers and understand what they are getting into as a cost of doing business.

Really, as pointed out the bank is a sophisticated investor/seller.

Most tenants aren't sophisticated enough to go to court and battle anything out.
