Not only is this legal, there are entities which support and help you find good, skilled, day laborers.The organization I worked for helped create the contract--which basically stated that you would indeed pay the worker and that you would not expose them to potentially harmful situations--and helped by keeping track of their income (so that they could file taxes EOY).Many people in New York took this route.
