You must provide a 30-day notice to vacate using the reason you want to inhabit the property as your principal residence.You should double check on that though.

@Patrick Bross I just scanned the SC Landlord and Tenants Act an @John Semanchuk is correct, there does not appear to be provision for the landlord to take possession of the property for the purpose of inhabiting it.

Nope...CapEx (Capital Expenditures) are the large repairs that you need to do every once in a while to keep the property in habitable shape, extend it's useful life and/or increase its value.

Yes, when I bought it, it was literally inhabitated with drug dealers and prostitutes so there was a lot of $$$ spent on legal fees to evict.Funny you mention shootings because when I bought it, one of the hallway windows did in fact have a bullet hole.

Rental real estate is placed in service on the day that both of the following happen (1) the unit is in habitable condition and (2) the unit is advertised as available for rent.I think you and your tax professional need to examine whether the occupants of the main house had use of the ADU either formally under their lease agreement, or informally.

I called a professional company, and they said that the reason we have seen such great results on our side, is because it's inhabited and likely did a lot of damage to the bugs because they've had to cross over the chemical.
