My understanding is that if it's expunged, you might not have to disclose it to a prospective employer, BUT I'm not so sure that means you don't have to disclose it to the state's real estate department.I was contacted some time back by a prospective real estate licensee who had a felony theft conviction (embezzlement) on their record from 20+ years earlier.

In my years of being a licensee here in Florida and the several courses I had to take for pre/post license requirements, the investor education piece is basically non-existent.

If you are not a licensee it is illegal to market properties you do not own.

In a case such as this, the licensee’s real estate knowledge and experience could put the other party at a disadvantage, if that other party was unaware of the licensee’s true status.This rule also applies to those licensees who advertise regarding their own property.
