@Edwin Epperson, while a Solo 401k does NOT have a custodial requirement, many Solo 401k plans have a custodian anyway.

I am potentially making this move to be closer to my kids school(shared custody) and I want to spend more time with them.

Not to rain on your parade but I have seen it happen all too often when things don't work out for a couple what the property gets stuck in a custody battle.
