Mediation is the primary mechanism for resolution though some select items can be brought directly into probate-- (mechanics lien, foreclosures) none of which are at play right now.

@Chis AnenWe don't do a lot of this because most of our offers are cash, as is - so there's not a lot of other levers.That said, if you're asking for contingencies, you can do things like:offer A is with seller providing no remediation of tree impinging on propertyoffer B is with seller providing remediation of tree impinging on propertyThe thing I'd advice (we have more experience on the seller side of a transaction when things were asked for) is that if you do ask a seller to re-mediate something be very specific on what your expectations for quality are.

They will also likely ask for a remediation report showing that the home was professionally re mediated of mold or properly dried out.

I mean really you have a few options U found it but you did not close .. refuse to close and or renegotiate.. its not like you have a bunch of damages.. if you are using an agent an they are standard MLS forms you probably have a mandatory mediation clause that U can invoke if you want to spend money.. at that point you can have lawyer.. but the closing lawyers what are they going to do about this other than tell you . if you don't like it don't buy it  LOL

In Ohio they can ask for mediation as well which if approved will get a new plan which they could fail then restart the process, then at the end most likely file BK.
