Under ALTA and Dodd-Frank the note holder has 15 days to provide a payoff with per deim interest after a scheduled settlement date good for 30 days, private or institutional note, it doesn't matter.There is a long list of claims to make against the note holder (who obviously wants the property back) violation of federal settlement requirements, associated settlement fees for any extension, interference with your contract, predatory lending delaying a payoff for accrual of interest, I'm sure there are more.

I am working on an investor ALT A loan originated by CW so I expect to have a 30 day restriction.

@Jay Hinrichs Good point.Nobody is in the title business anymore unless they are ALTA Best Practices compliant -- either third party certified or lender verified.

You also include the renovations in the initial purchase.If you include on your closing statements (which vary state to state - HUD-1/ALTA statement ) the renovation costs - and have them charged at closing......

ALTA has an opinion of deeds being effective when made, not filed, so exchanging a Warranty Deed and a Quick Claim, regardless of who's drawer they are kept in, simultaneous deeds cancel each other out, hope the parties can go to another closing.

Deed in lieu of foreclosure can not be pre-arranged and still hold water as it could in the past, so I have to disagree with Rick to some extent.Deeds may be deemed effective when executed, filing perfects the deed, in some states it's the race to the courthouse as to priority but, speaking on a national stage, consider ALTA's concerns, which I've posted before.
