If the complainer can't smell it in their apartment, but, are uptight enough to be bothered by the passing smell in the hallway...it may not be the smoker that has the problem.I have found that complainers/boat rockers are often wound a bit to tight, and that when you are a highly responsive empathetic landlord, they turn you in to their own personal karma delivery machine, to right all the wrongs that previously fallen on deaf ears.Good luck.

I would imagine the best actions would be to immediately fire the management company, pass the keys onto a new one, sue the old one in small claims court for the listed damages.

And yeah Marquette, MI is an appreciating market and a college town where everyone complains about increasing rents (and their bad landlords).Hopefully I can still find a few properties that can cash flow anything, no matter how small, with zero down but I'll have to see if they'll pass VA inspection too.

Have 2-3 contractors look at the job and get written estimates on what it's going to take to finish the job, correct the mistakes, pass occupancy certification etc. use those estimates in your countersuit / mediation process. 4.
