IRC Sec 469 generally characterizes rental real estate as per se passive under IRC Sec 469(c)(2).If the taxpayer is able to qualify as a real estate professional under IRC Sec 469(c)(7)(B), IRC Sec 469(c)(7)(A) allows the taxpayer to apply a material participation test to his/her rental real estate activities for a passive / non-passive determination.
