Or they will call back to recover the rent, and you will have the chance to come to an agreement: they clean the place up and move their stuff out and you pro rate the rent for the overage days, or they leave their stuff and you charge them the months rent and keep the security deposit to cover cleanup and repair.I have had plenty of awkward endings with tenants, and never once did it end in court.

The car belonged to a worker who was at that house doing some maintenance (the owners weren't home), so it's me, him, and her in one of the most awkward situations anyone could find themselves in...and finally 20 mins later she makes a phone call, and it's to someone she was letting live on her property that I didn't even know was there the whole time, and he comes down on foot as well (another 20 mins), and he also becomes inconsolable when he sees for himself what happened!

So 123 Apple Valley Road (the one you just sold), buys their 1031 as 789 main street LLC (the only member is 122 Apple Valley Road and mainstreet LLC does not file a tax return).  123 LLC would also buy to complete the 1031, 654 Oyster Ave(another disregarded LLC where 123 is the only member and Oyster does not file it's own tax return).This will still be a little awkward for you as 123 LLC (the S corp) owns 789 LLC and 654 LLC. 

Many agents will promise you the world to get the listing, and then you'll both sit their awkwardly as the property doesn't sell.
