I have a file in escrow now where the Court assigned a professional mediator to act on behalf of two sellers who were not cooperating with each other.

Investigations and examinations to determine violations; obtaining evidence; witnesses and subpoenas; confidentiality; injunctions and other means of enforcement; cooperation with other enforcement agencies.

It's a mess make sure they all cooperate and any furniture / mattresses put outside for trash paint it with spray paint BED BUGS so it doesn't reappear. 

Let your current tenants know that it is in their best interest to cooperate with you by keeping the place clean and available for showings because the sooner you get renters in there, the sooner they will be off the hook for rent going forward.You cant just keep a security deposit without tying the amount you kept to some actual damage you suffered.  

They've been cooperative in the past with HOA notices.

I am not sure if  you were clear and specified the last month would be ok to use part of the security deposit but it is my thought they are doing what they are doing and you have to get them co-operating with what you need to do to sell the house.  

Bump up the value to at least $100k+ and you should get much easier cooperation from the banks, lower risk, higher profits for you, and usually with far fewer headaches too.

If your rental is in a hot area of town, and your tenants are cooperative in helping the property show well, then just do it.
