As the P&S date read "7 days post lien approval" we discussed that the post lien date would be last Friday since that's when the buyers said they would accept the banks counter offer.We expected to sign the P&S this week, but now we are being told that it will take another 2 weeks to get the approval letter from the bank so we need to postpone the P&S date.

Then you have to buy something of equal or greater value.You could do the 1031, buy the new property/s and then still do a cash out refi if you wanted to.The 1031 will allow you to postpone capital gains taxes, maybe indefinitely if you keep doing this or hold the property you buy and pass it on to your heirs.
