That would lead to them constantly complaining to you and making you mediate for them every time a problem comes up. 

The contract does stipulate that both parties agree to a mediation if there is a dispute before taking legal actions.

They will offer to pull the tank and re mediate the problems if there are any.  

Along with again most all of the RE forms have mandatory mediation clauses..Please do not sweat this.. it will go away.. you can be furious with your agent though sounds like some bad advice there..
