If, for some reason, he can not provide the unit any longer, is the ONLY situation where he would need to refund this money.Interest is irrelevant, there is no requirement what so ever to put this person's money into an interest bearing account, nor is there any amount of interest set by statute here.

I'm not aware of a similar Ohio statute that would apply state wide (though admittedly I've never searched for one either).I only advise my clients use it in very specific situations, as it is typically slower than eviction.

@Jordin BoydMake sure you know the NC statute on LOsCreate a brand new lease and separate option, 12 mo on lease and separate option at a price you both can live with.I would have the option price reflect a sales price based on today's appraisal or CMA less option payments paid but optionee is responsible for seperate down payment for FHA financing
