We are getting better at enforcing all of our rental agreement terms quickly and moving people out who continue to be a problem and those that can't or won't pay.We end up writing off bad debt instead of going to small claims court, because the chances of getting money after a judgement is slim and a lot of work.

You will get a default judgement but then you'll have to collect on it - meaning you'll need to know where he banks so you can attach his bank account or where other assets are located. 

This is not being "mean".I know a landlord that only rents to tenants who are not "judgement proof."

Lease violations and non-payment of rent are contractual breaches and outside circumstances of the tenant should not affect the judgement.
