There should be no restrictions on the distribution,  it is his money, the contributions will come out tax free since it is Roth (post tax), and earnings would be assessed with penalties and taxes because of the premature distribution.

@Nicholas Patrick,What you're missing is that you don't withdraw anything - no pre-mature distributions, no taxes, no penalties.You're INVESTING your 401(k) in something OTHER THAN Wall Street - better security, less volatility.Wall Street can MAYBE get you a 10% return.

It is unfortunate that you acted prematurely but I don't believe you can hold the lender or the loan officer responsible unless you were specifically told to remove the contingencies.
