I'm assuming your main point is the second one, hence the misuse. 

They are really trying to crack down on gross misuse.

Yes, there are serious and complicated differences and a lot of misuse of the terms.

@Warren Lance Barber - The terms of your lease and what you have communicated would be the items I used to drive what should and should not be charge.A good lease copy needs to protect the landlord from tenants breaching the terms, damaging the property, and. tenant negligence/misuse.
