In some states there is mandated mediation, which is the creditor and debtor coming together to see if there is any deal to workout which helps the borrower reinstate the loan and continue to pay.  

If you are representing yourself and you are a real estate professional and the seller has no representation, then a mediator/judge will side with the seller, you better have scrupulous notes of every conversation, text and email.

If they are properly re-mediating the property by taking care of the bed bug problem you might wait.

You can ask mediator for payment plan, accept current rent, and get a settlement agreement for a  payment plan for the next month's rent also, so your not stuck with thinking your going to have to do it all over again, the agreement would include court filing costs.

If there's a negative balance, that's your damages.Texas encourages real estate disputes to be handled through mediation, but small claims court would be your ultimate destination if the tenant doesn't pay.
