Well, thats for a judge or arbitrator to decide and intent can be dificult to prove. getting compensation can also be very difficult.With a REO or short sale, the lender is simply disclosing that there no guarantees as to its condition which is for purposes of indemnification.

Check local HOA law and your Governing Docs, you probably will be required to go to mediation and/or arbitration rather than small claims court, at least initially.
